Sexual assault is the most severe type of sexual offences, as in Spain it is defined as having non-consensual sexual relations using force or intimidation to subdue the victim into having a sexual encounter they never consented to. If vaginal, oral or anal penetration occurs during the sexual encounter, then it is defined as rape.

The sentences for committing sexual assault are very severe, in line with the heinous nature of the crime: where there is no penetration, a person charged with sexual assault may face up to ten years in prison; in case of penetration, it can be as high as fifteen years, the same as in the case of homicide.

This crime becomes even more repugnant when a victim is assaulted by a group of individuals, commonly known as “gang rape”. In these cases, sentences can be even tougher if a series of aggravating circumstances are present.

WHAT TO DO IF…

If a woman has gone through the traumatic experiences of being raped, the first thing she must do is rush to a hospital so she can be examined, and the injuries she likely has can be treated.

She can also call the police, who will appear immediately at the location indicated and can accompany her to the hospital.

Family members and friends of the victim must talk as soon as possible to a lawyer to guide them through the initial steps in this particularly traumatising situation.

Yesterday my husband came home drunk and wanted to have sex. I didn’t want to, and even though he insisted I refused again and again. He became violent, grabbed me by the wrists, threw me on the bed, ripped my clothes off and raped me. Yes, I was raped by my own husband.

Three nights ago, when we were out clubbing, my friends and I met a group of four boys. I liked one of them, so when my friends left I stayed behind with them. The boy I liked suggested we go off into the woods and I accepted. What I didn’t know is that five minutes later his three friends would appear; they started kissing and touching me. I was paralysed with fear, and didn’t dare stand up to any of them. They all raped me.

Last night I was walking home when suddenly a very strong man threw me to the floor and raped me. When he left, I was hysterical, but I managed to call the police. They arrived immediately and took me to the hospital; meanwhile, other officers managed to arrest my rapist.
